Welcome to the Pro Racing Virtual Car Racing Simulator (the "Simulator"), provided by Pro Racing ("we," "us," or "our"). By accessing or using the Simulator, including its Motion Wheel and Motion Seat components (collectively, the "Service"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By using the Simulator, you acknowledge that you have read, understood, and agree to these Terms, as well as our Privacy Policy [insert link]. 2. Eligibility

4. User Responsibilities

Safety: You agree to use the Motion Wheel and Motion Seat responsibly, following all provided instructions and safety warnings. Do not use the Service under the influence of alcohol, drugs, or any substance that impairs your ability to operate it safely.

Equipment Care: You are responsible for any damage to the Motion Wheel, Motion Seat, or other Simulator components caused by misuse or negligence.

Conduct: You will not use the Service to engage in illegal activities, harassment, or any behavior that disrupts other users’ experiences.

5. Health and Safety Warnings

The Simulator includes motion-based features that may cause discomfort, dizziness, or injury if not used properly. By using the Service, you acknowledge the following:

- The Motion Wheel and Motion Seat may move suddenly or intensely during gameplay.

- Prolonged use may result in fatigue, motion sickness, or strain.

- Stop using the Service immediately if you experience discomfort, nausea, or any adverse effects, and seek medical attention if necessary.

- Pro Racing is not liable for injuries resulting from failure to heed these warnings.

6. Payment and Subscriptions

Some features of the Service may require payment or a subscription. Pricing and payment terms will be provided at the time of purchase.

All payments are non-refundable unless otherwise stated or required by law.

Subscriptions may auto-renew unless canceled prior to the renewal date.

7. Intellectual Property

The Simulator, including its software, design, and content (e.g., graphics, audio, and virtual environments), is owned by Pro Racing or its licensors and is protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. User-Generated Content

If the Service allows you to upload or share content (e.g., race replays, custom designs), you grant Pro Racing a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with the Service.

You are responsible for ensuring your content does not violate any laws or third-party rights.

9. Limitation of Liability

To the fullest extent permitted by law, Pro Racing is not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to injuries, equipment damage, or loss of data.

10. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for violations of these Terms or for any other reason. Upon termination, your license to use the Service ends immediately.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. Any disputes will be resolved in the courts of Victoria, Australia.
